64. Withdrawal Requests

65. The Player may at any time request a payout from the existing balance of his/her User Account in whole or in part, provided that all payments and winnings have been confirmed and all amounts deposited. Any expense related to withdrawal requests shall be charged to the receiver.

66. The minimum amount for withdrawal requests is of 20 Euros using MoneyBookers, Neteller or Click2Pay and of 30 Euros using wire transfer or by credit card.  To withdraw money from his account, the player must have made a minimum deposit of £30.

67. Withdrawal requests shall be processed immediately. Mandarin Gaming maintains a target of forty-eight (48) hours for the processing of payouts but does not hold itself liable for a specific period of time in this regard. In the event that a subscriber has increased his User Account balance by sending a fax copy of the transfer receipt related to a postal money order or bank transfer, the date shown on the receipt must coincide with the payment date into the Mandarin Gaming bank account otherwise it shall not be possible to withdraw any winnings.

68. Withdrawals from a User Account can only be addressed to the person registered to the account and as per the conditions specified on the Mandarin Gaming site. Payouts should be to the same destination as where the funds originated from, with the exception of cases where the payment solutions used by the Player do not offer the redirection of payouts (MasterCard).

69. An administration charge shall be applied for payout requests referring to amounts deposited with Mandarin Gaming and which have not been used at least once for playing poker Games. This percentage will vary according to the mean of payment

 

70. Mandarin Gaming reserves the right to suspend a cash-out request pending verification of Player’s identity, age and location.

71. In any case, Mandarin Gaming shall not make a payment in excess of two thousand three hundred Euros (€2,300) out of a Users account to a Player until the Player’s identity, age and place of residence have been verified.

Errors

72. Should funds be credited to a Player’s Account in error, it is the client's responsibility to notify Mandarin Gaming of the error without delay. Any winnings subsequent to the error and prior to the notification of Mandarin Gaming, shall be deemed invalid and returned to Mandarin Gaming, provided they are linked to such an error.

Changes to Account Balance by Third Parties

73. Mandarin Gaming cannot be held liable for changes to a Player’s Account balance due to someone else using that Player’s nickname, username or password.

Credit/Debit Card

74. Players may only use their own credit / debit card in their own account. Any deposits made using another individual’s credit / debit card will be refunded and any games played with funds from such a card will be deemed void.

Financial Information / Documents

75. Mandarin Gaming hereby ensures the security of all financial information about the Player and financial documents whether relating directly to the transactions between the Player and Mandarin Gaming or between Mandarin Gaming and the relevant tax authorities.

Proof of Payments

76. The Player acknowledges that Mandarin Gaming reserves the right to request proof of payment to Player Accounts for all alternative payments, at any moment, (i.e. Click2Pay, MoneyBookers, Neteller and Neosurf Invoices). Mandarin Gaming reserves the right to request its clients’ bank account numbers at any time.

Financial Protection of Players

77. The Player may by written notice or electronic notice to Mandarin Gaming:

(vi) set a limit on the amount the Player may wager within a specified period of time;

(vii) set a limit on the losses the Player may incur within a specified period of time;

(viii) set a limit on the amount of time the Player may play in any one session;

(ix) exclude the Player from playing for a definite or indefinite period of time.

78. A Player who has set a limit or exclusion may change or revoke the limit or exclusion by written notice or electronic notice given to Mandarin Gaming.

79. A notice increasing or revoking a limit or decreasing the exclusion has effect after seven days after Mandarin Gaming has received the notice.

80. A notice reducing a limit or increasing the exclusion has effect immediately after it is received by Mandarin Gaming.

81. Mandarin Gaming shall not accept a wager from a Player contrary to a limit or exclusion set by the Player under these T&Cs.

Contracts

82. A Player enters into a Gaming Contract with another one or more participant(s) of the Internet Site on such terms and conditions as the Player and such other participant(s) agree through the Internet Site and so long as the Player has sufficient funds in his Mandarin Gaming account.

83. Each time the Player enters into a Gaming Contract, the terms thereof will be recorded on the Internet Site. Once a Gaming Contract is signed, neither Player nor the other party or participant thereto will be able to change any of its terms and each one of them agrees that such information as is recorded by Mandarin Gaming shall constitute the terms of each Gaming Contract.

84. Each offer made by a Player to sign a Gaming Contract will be open for another participant to accept on the Internet Site up to:-

(i) the conclusion of a Game;

(ii) the player’s withdrawal of the offer, prior to another participant accepting;

(iii) any decision by the Player to suspend and/or cancel his offer, if, in its discretion, Mandarin Gaming considers it appropriate to do so, in regards to anything related to the course of the Game in question.

85. When a Player posts on the Internet Site his willingness to enter into a Gaming Contract or by indicating on the Internet Site his acceptance of the offer of some other participant to enter into a Gaming Contract, the Player irrevocably authorizes Mandarin Gaming to create each Contract on the basis that the Player will be supplied with no details of the identity of the participant(s) who is the other party to each Contract nor will such a participant receive any details about the Player.

House Commission

House commission is referred to as the “Rake” at cash game tables and the “Fees” for tournament and Sit & Go buy-ins. The rake and fees only apply to real money tables and games. Software Rules – Artificial Intelligence

86. The use of artificial intelligence is strictly forbidden in connection with the Software and the Games. Mandarin Gaming is committed to detecting and preventing software programs which are designed to enable artificial intelligence ("AI Software") to operate on the Mandarin Gaming Internet Site, for example for opponent-profiling, cheating software or anything else that Mandarin Gaming deems enables You to have an unfair advantage. All actions taken in relation to the Games by a User must be executed personally by Players through the user interface accessible by use of the Software. The Account Holder acknowledges that Mandarin Gaming will take measures to detect and prevent the use of such programs and AI Software using methods (including but not limited to reading the list of currently running programs on a Player’s computer) and the Account Holder agrees not to use any AI Software and/or any such programs.

Competitions and Promotions

87. Parts of the Internet Site may from time to time contain competitions, promotions, tournaments or similar and related activities offered by Mandarin Gaming or by third parties. Any specific additional terms and conditions for participation in any such competitions, promotions, tournaments or similar and related activities will be specified on the relevant part of the Internet Site from time to time. By entering or participating in the relevant competitions, promotions, tournaments or similar and related activities, the Player agrees to be bound by those terms of participation in addition to these T&Cs and in the event of any conflict or inconsistency, the terms of participation will prevail. Mandarin Gaming specifically retains the rights, at any time and without notice, to remove, alter or add to competitions, promotions, tournaments or similar and related activities on the Internet Site without liability to the Player.

Abuse of Promotions

88. The Player binds himself not to abuse opening accounts in order to benefit from bonus credits and other promotional offers that Mandarin Gaming may offer. Mandarin Gaming reserves the right, in case of abusive behaviour on the Player’s part as related to bonus credits and/or to promotional offers by Mandarin Gaming, in its sole discretion, to rescind or block User Accounts created for that reason, as well as their transactions.

Game Cancellation

89. Mandarin Gaming reserves the right to cancel any Game, whether before the start of the Game or during the event. 90. If a tournament is cancelled before the actual start of that tournament and it is officially announced on the Mandarin Gaming Internet Site, the Player’s buy-in and entry fee, if any, will be refunded to the User Account and the Player will return to his former status. 91. If a Game is cancelled after the start time of that Game but before the outcome is decided, (e.g.: due to a technical failure or due to any other foreseen/unforeseen circumstances), whether or not within the control of Mandarin Gaming), Mandarin Gaming shall not be, in any way whatsoever, responsible for such a cancellation. In such cases, the Mandarin Gaming policies shall apply.

90. Results of Games

91. Once Games have finished, their result cannot be changed or cancelled. Mandarin Gaming retains the right to accept, not to accept or to partially accept Games results.

92. Winnings

93. The printout of a Game that has been played is not considered to be a receipt of the winnings. A Game shall be considered as having been won if it is listed on the Player’s games list/on the Mandarin Gaming game server(s).

Conflict in Results

94. In case of conflict between the result posted on the Software and the result posted on our server, the result posted on our server shall take precedence. The Account Holder understands and agrees that Mandarin Gaming and the company’s records shall be the final authority in determining the terms of his participation in the Games, the activity resulting from them and the circumstances in which they occurred. Hence, You understand and accept that the settlement of any conflict between the User and Mandarin Gaming will be determined based on the records kept by Mandarin Gaming.

Disputes

Mandarin Gaming will not consider any claims or disputes on Games to be valid unless the said games are directly registered in the Mandarin Gaming database files or records. Game Integrity

95. Only the player can see the cards that he holds during a game. Nobody in the back-office from Mandarin Gaming can monitor live playing hands. Only after the hands have been played, can administrators check hand histories. Ensuring game integrity is top priority for Mandarin Gaming. Chatting Rules

96. The game services offered by Mandarin Gaming are intended to offer a fun and pleasant experience. Therefore, any abusive or obscene language is not tolerated, and Players who insist on using offensive language will have their chat privileges revoked.

Anti-Collusion Measures

97. Collusion between players by sharing hole cards or by other methods is strictly forbidden. Mandarin Gaming reserves, in addition to other measures, the right to restrict seating and/or to prohibit Users from playing at a particular poker table or in a tournament, including restricting two or more Users from playing together at the same table or in the same tournament. Reference here is also made to the rights of Mandarin Gaming to take measures in order to prohibit “multi-accounting” practices.

98. Mandarin Gaming also reserves the right to terminate accounts with immediate effect in the event of collusion, as well as the right to block all the User’s funds until poker investigations are concluded.

Offensive behaviour

99. Any abusive and obscene language is not tolerated at Mandarin Gaming. Players who insist on using offensive language will have their chat blocked. We would like to make Mandarin Gaming a fun and pleasant place. Mandarin Gaming intends to offer a fun and pleasant experience. Therefore, any abusive and obscene language is not tolerated, and Players who insist on using offensive language will have their chat privileges revoked.

Complaints

100. Objections or complaints concerning the operation of Games have to be presented before the start of the game that is subject to the said objections or complaints.

101. The Player is hereby acknowledging and accepting that any complaint or contest made by the Player more than seven (7) days after the date of the finalisation of the transaction which is the subject of the complaint in question shall not be taken into account, and shall have no value.

Fraudulent Activity

102. Mandarin Gaming has a zero tolerance policy towards inappropriate play and fraudulent activity. If, Mandarin Gaming determines that the Account Holder is found to have cheated or attempted to defraud the company, or any other user of any of the Games in any way including, but not limited to game manipulation or payment fraud, or if the Company suspects the Account Holder of fraudulent payment including use of stolen credit cards, payment fraud or any other fraudulent activity (including any chargeback or other reversal of a payment) or prohibited transaction (including money laundering), Mandarin Gaming reserves the right to suspend and/or close the player’s Account and to share this information (together with his identity) to other online gaming Internet Sites, banks, credit card companies, and appropriate agencies.

Software

End-User License

103. By playing on the Mandarin Gaming Internet Site you are being granted a personal non-exclusive, non-transferable licence to use the Software, in order to play on online poker, according to these T&Cs and including the clauses in this section.

The Account Holder may install and use the computer programs provided by Mandarin Gaming on a hard disk or other storage device and make backup copies, provided that such use and backup copying is only for the Account Holder’s own personal use, for participating in the Games in accordance with this Agreement, and further, that such installation and use is on a computer of which the Account Holder is the primary user. The Software's structure, organisation and code are the valuable trade secrets of Mandarin Gaming and/or its group of companies and/or its licensors. The Account Holder obtains no rights to the Software except to use it in accordance with this Agreement. Save as expressly permitted by law, the Account Holder is strictly prohibited from, and agrees not to modify, adapt, translate, reverse engineer, decompile, disassemble or otherwise attempt to discover the source code of the Software or any part of it or to create, publish or distribute derivative works from the Software. The Account Holder agrees that the Software will not be shipped, transferred or exported into any country or used in any manner prohibited by any applicable laws, restrictions or regulations.

105. Mandarin Gaming grants only a personal right to Players to use the Software and the Internet Site. It is a right that is bestowed personally on the Players in order to play Games of chance on the Internet Site. This right is given to the Players for a personal and not a commercial purpose. Any complaints relating to activity on your account by a third party will not be accepted by Mandarin Gaming since it is prohibited to enable a third party to play with a Player’s account. It is the Player’s responsibility to inform Mandarin Gaming immediately if the Player suspects that his account is being used by a third person, so that Mandarin Gaming may inspect and verify that Account.

The amount in question will not be credited to the Player’s account. The Player will be denied access to all other Internet Sites, services and software offered by the same corporation.

109. True Random Number Generator

110. The Account Holder accepts and agrees that the true random number generator ("TRNG") and/or the Mandarin Gaming Quantum Photon Shuffler (“QPS”) determines the outcome of every Game.


Software Interruption

111. In the event of any kind of software interruption due to any type of problem, Mandarin Gaming reserves the exclusive right to request a screenshot.

Disclaimer & Limitation of Liability

Use of Web Internet Site

112. Mandarin Gaming shall in no event, nor under any circumstances, be liable for any damages or losses that are deemed or alleged to have resulted from or caused by its Internet Site or its content, including, without limitation, delays or interruptions in operation or transmission, failure in communication lines, any person's use or misuse of the Internet Site or it's content, or any errors or omissions in content.

113. Mandarin Gaming cannot be held liable for changes to a Player’s Account balance due to someone else playing or executing an IAT (inter-account transfer) using that Player’s nickname, username or password.

114. Mandarin Gaming makes every effort to maintain the accuracy of the information on the Internet Site but cannot accept responsibility for any prejudice, loss or damage which may occur from use of the information.

115. No responsibility is being acknowledged or accepted hereunder for, inter alia, the following matters:

(ix) legal actions and/or other remedies.

116. Therefore it is hereby being specified that Mandarin Gaming makes no representation, pledge or warranty (either explicit or implicit, including but not limited to warranties for accuracy, fitness of purposes or non-infringement) that the Content is accurate and/or suitable for any particular purpose other than in so far as those warranties which cannot be expressly excluded under the governing law of these T&Cs.

117. Use of the Internet Site is entirely at the Account Holder’s risk. The Internet Site and its content is provided on an ‘as is’ basis.

Services

118. Mandarin Gaming offers services and software on an « as is » basis, with no warranties, assurances, engagements, or any declaration, explicit or implied, legal or other. Mandarin Gaming hereby excludes all terms, conditions, and warranties explicit or implied, including but not limited to implied warranties, commercial conditions, and or matters of satisfactory quality, ability and adaptability to a specific end, completion or precision of service and of the Software in respect to the failure to respect governing rules and laws.

119. Mandarin Gaming does not guarantee that the services or the Software are authorized, and that the operation will fully satisfy the Player, that it is entirely secure and exempt from error, that it is updated regularly, that any Software defect is regularly corrected, that it is uninterrupted, that the service or the Software are virus or bug free, or that they are continually operational, that they are adequate, that the material is reliable, or that all other information obtained by way of the service or that all results are adequate and reliable.

120. In case of discrepancies in the systems or in the means of communication, due to viruses or bugs as it relates to the account regulations or all other parameters that make up the Software, Mandarin Gaming shall not be held responsible by you or a third party for any damage, costs, expenses, losses, or claims brought about by these said discrepancies, and reserves the right, in the event of such types of errors, to cease all Software and Games concerned and to take all other measures necessary to correct such errors, provided that Mandarin Gaming is not responsible to provide an emergency network, system, or similar emergency services.

121. Mandarin Gaming cannot be held responsible for any act or omission by an internet provider or of any other third party with whom you may have contracted in order to have access to Mandarin Gaming’s service and/or Software. In case of litigation between the internet provider and You, Mandarin Gaming cannot be party to the lawsuit, and this lawsuit shall in no way affect the User’s obligations under this Agreement.

Player’s Risk

122. The Player acknowledges to have chosen and used the Service and the Software willingly and at his own risk and discretion.

Loss or Damage

123. Mandarin Gaming is in no way responsible for any loss or damage, direct or indirect, that You or a third party might have suffered as a result of your use or the third party’s use of the Internet Site and or of the Software, including but not limited to damage caused by a commercial loss, a loss of benefits, a loss on anticipated profit, interruption of business, loss of commercial information, or any other pecuniary and or consecutive loss.

124. We are in no way responsible for any loss or damage that You or a third party might have suffered as a result of your use or their use of the Internet Site, its content or that of any link suggested by Mandarin Gaming.

125. We are in no way responsible for any loss or damage that You or a third party might have suffered as a result of any modification, suspension or interruption of services on the Internet Site or of the Software.

126. We are in no way responsible for any loss or damage, including but not limited to a loss of profit, as a result of improper functioning of the Internet Site and or of the Software, any delay, interruption, transmission, loss or corruption of data, improper functioning of the means of communication, criminal use of the Internet Site or of its content by any person, of a defect, or omission or of any other factor beyond our control. In the event that the malfunction results in profit, whether it be collected or credited to your account, Mandarin Gaming reserves the right to claim all winnings that You may have benefited from as a result of one of those malfunctions, and You would be obliged to immediately reimburse Mandarin Gaming the amount collected and to inform Mandarin Gaming of the malfunction. Mandarin Gaming reserves the right, at its sole discretion, of directly deducting from your account an amount equal to that which You may have received in error.

127. Breach of Agreement

128. If you fail to adhere to any of the conditions of this Agreement or if we reasonably suspect that you are failing to comply with any of the conditions of this Agreement, Mandarin Gaming reserves the right and all remedies at its disposition, and at its sole discretion, to block your user account, as well as indefinitely banning your access to the Internet Site and Software belonging to Mandarin Gaming, and will have the right to take legal action against you and to withdraw the necessary amount from your account in order to compensate the damage suffered by Mandarin Gaming, or in exchange of any amount due to Mandarin Gaming, and until ruled upon it by a court of law.

Legal Compliance

129. Account Holders are advised to comply with applicable legislation in the jurisdiction in which they are domiciled and/or resident. Mandarin Gaming accepts no responsibility for any action taken by any authority against any Account Holder.

Limitation of Liability before a Court of Law

130. In the event that Mandarin Gaming is found liable in any way, by a court of law and/or a similar authority, with legal competence and/or jurisdiction over Mandarin Gaming, then Mandarin Gaming's liability shall be limited to the amount of the stake, or the net winnings, relevant to that particular Player, whichever is the lesser. Alternatively, when relevant and applicable, the amount recorded in the Mandarin Gaming Account or the amount transferred into or out of the Mandarin Gaming Account, whichever is the lesser.

Term and Cancellation

131. This Agreement is effective immediately after clicking on « I agree » and remains valid until it is cancelled in accordance with the conditions stated herein.

132. You can cancel this Agreement at any time in writing to [Co Name Correspondence Address], under the condition that you have no outstanding amounts with Mandarin Gaming, for any reason. The cancellation of this Agreement becomes effective only after you have received a notification in writing from Mandarin Gaming confirming the cancellation. From the moment that this Agreement becomes invalid, you will no longer be authorized to use the Internet Site and the Software, and you will be obliged to

133. erase the Software from your computer and to destroy all documentation, related to the Internet Site or to the Software, under your possession, in your power or under your control.

134. Immediately following the cancellation of this Agreement, by either party, Mandarin Gaming is bound to reimburse the integral amount indicated in your User Account, only after the deduction of any amount owed to Mandarin Gaming, if any.

135. The cancellation of this Agreement shall not be cause of prejudice to any other right or engagement of either party in regards to any violation stated herein or any other violation.

136. All existing obligations between the parties to this Agreement will be null and void after the cancellation of this Agreement, and for whatever reason, except if provided otherwise, under the reserved rights and obligations accepted prior to the cancellation.

Miscellaneous Provisions

Intellectual Property

137. The Mandarin Gaming Internet Site is intended solely for use by Account Holders. In any event, no one is authorised to copy, modify, tamper with, distribute, transmit, display, reproduce, transfer, upload, download or otherwise alter the Content of the Internet Site.

138. The display of any trademarks, including the Mandarin Gaming TM (registered Community Trademark No10/3715492), within the Internet Site does not grant any User of the Internet Site a license of any kind to use it.

139. Any unauthorised downloading or copying of any material contained in the Mandarin Gaming Internet Site as well as the design of the Internet Site itself may be considered as a violation of applicable intellectual property rights within the European Union.

140. The Internet Site may only be used for lawful purposes. Use of the Internet Site for transmission, distribution, publication or storage of any material on or via the Internet Site which is in violation of any applicable law or regulation or any third party's rights is strictly prohibited. This includes (but not limited to) the use of the Internet Site or the transmission, distribution, publication or storage of any material on or via the Internet Site for a purpose which infringes copyright, trademark, trade secret or other intellectual property rights, is obscene or harmful to minors or constitutes an illegal act or harassment, is libellous or defamatory, violates any privacy or data protection laws, is fraudulent or breaches any exchange control or gambling law. It is solely for you to establish whether your registration with and use of the Internet Site and/or your entry into this Agreement (or your offering so to do) is lawful. 141. These T&Cs are not intended to create any partnership, agency or joint venture between Mandarin Gaming and the Account Holder.

Minors

Waiver
